  1. General
  1. The following contractual provisions (GTC) apply to all contracts concluded with the customer (hereinafter: CUSTOMER) via the online shop (hereinafter: SELLER) under the domain www.priceflash.shop.

  2. The presentation of the products in the SELLER's online shop merely represents a non-binding invitation to the CUSTOMER to place an order. By placing the order, the CUSTOMER makes a binding offer to conclude a contract for the items contained in the shopping cart. The SELLER will automatically confirm receipt of the order immediately by email. The automated order confirmation of the shop system does not create a contractual relationship. A contract is only concluded when the SELLER accepts the CUSTOMER's offer by delivering the ordered items to the CUSTOMER. The purchase contract with Price Flash, Großwöllmiß 40, 8580 Sankt Martin am Wöllmißberg is only concluded with this separate declaration of acceptance.

  3. Only private individuals are considered CUSTOMERS.





  1. Changes
    SELLER reserves the right to update these terms and conditions as necessary. Changes will be communicated to CUSTOMERS in a timely manner and will only be effective with the CUSTOMER’s consent.

If the CUSTOMER decides to pay via PayPal, the order will be completed after being redirected to the PayPal page by clicking on the “Complete purchase” button.
  2. Orders exceeding quantities typical for private consumption may be rejected or canceled. The CUSTOMER receives a notification about this.
  3. The CUSTOMER can correct input errors, especially items placed in the shopping cart by mistake, by entering the desired quantity in the shopping cart and using the available buttons. During the ordering process, the CUSTOMER can correct input errors in the various steps by navigating to the respective step using the “forward” and “back” buttons in the browser.
  4. By completing the order, the CUSTOMER declares that he has read the terms and conditions, the data protection regulations and the cancellation policy.
  5. The contract language is German.

    If the CUSTOMER is a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to their commercial or independent professional activity), the CUSTOMER is entitled to a right of withdrawal in accordance with the statutory provisions.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

You can use the attached sample cancellation form, although this is not mandatory.
In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.

Consequences of revocation

If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract (see note: Return of products). The deadline is met if you send the goods before the fourteen day period has expired. You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

  • Exclusion or premature expiry of the right of withdrawal


    The right of withdrawal does not apply to distance selling contracts:
  • for the delivery of goods that can spoil quickly or whose expiry date would quickly be exceeded;
  • for the delivery of sealed goods which are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery;
  • for the delivery of goods if, due to their nature, they were inseparably mixed with other goods after delivery.
  • If advance payment has been agreed, delivery will take place after receipt of the invoice amount.

 

  1. Note: Returning products
    If possible, the goods should be returned in the original packaging with all accessories and packaging components to ESN - Logistics Center, Kirchenweg 7, 24568 Nützen. The SELLER requests that protective outer packaging be used to ensure adequate protection against any transport damage if the original packaging is no longer available. Damage and contamination of the item to be returned should be avoided. CUSTOMERS are asked to send the physical products back to the seller as a prepaid package and to keep the delivery receipt. The costs for returning the goods must be borne by the CUSTOMER. THE SELLER points out that the right of withdrawal and its consequences naturally exist regardless of whether this information is observed; it only serves to make the return process easier.

  2. The prices displayed in the online shop are stated in euros and include VAT.
  3. When purchasing goods that are delivered in a package or in any other way by post, the following applies: The prices displayed in the online shop do not include shipping costs for packaging and postage. The shipping costs are calculated dynamically during the ordering process and displayed in the shopping cart overview before ordering.

  1. The SELLER only accepts the payment methods offered during the ordering process in the online shop.
  2. A guarantee only exists for the goods delivered by the seller if this has been expressly provided. Customers will be informed about the warranty conditions before initiating the ordering process.
  3. The CUSTOMER selects his preferred payment method from the available payment methods.
  4. Paypal: If payment is made via PayPal, the CUSTOMER must have a PayPal account and identify themselves with their PayPal access data. The CUSTOMER must then go through the PayPal payment process and confirm the payment to the SELLER. You can also pay using the PayPal payment method without a PayPal user account. With regard to PayPal's guest function, the provisions available via the payment method apply. If the CUSTOMER chooses to pay via credit card in PayPal, depending on the amount to be paid or the type of delivery, the CUSTOMER may be asked for a required second authentication feature when the credit institution's website is displayed. The CUSTOMER must then verify the payment process with their personal second authentication feature such as password, PIN, TAN or biometric data such as fingerprint or face scan using a special app.
  5. Credit card: If a delivery is made against payment by credit card, the CUSTOMER, by disclosing his credit card details, authorizes the full invoice amount, including any applicable delivery and shipping costs, to be charged to the relevant credit card company when due. At the end of the ordering process, the CUSTOMER will be asked to enter his credit card number, the expiration date of the credit card and the verification digit in the appropriate form. Depending on the amount to be paid or the type of delivery, the customer may be asked for a required second authentication feature when the credit institution's website is displayed. The CUSTOMER must then verify the payment process with their personal second authentication feature such as password, PIN, TAN or biometric data such as fingerprint or face scan using a special app. The specific type of identification used depends on the respective payment service provider (e.g. the CUSTOMER's credit card company). In this case, the debit will be initiated with the order confirmation.
  6. Klarna invoice: In collaboration with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the Klarna payment method. Payment is made to Klarna. Further information can be found in Klarna's terms of use . Your personal data will be processed by Klarna in accordance with applicable data protection laws and as described in Klarna's privacy policy .
  7. If a delivery is made against payment via eps transfer, the CUSTOMER needs an online banking account with one of the participating banks. At the end of the ordering process, the CUSTOMER selects the bank and logs into the private online banking area. There the CUSTOMER checks the payment details that have already been entered. If these are correct, the CUSTOMER authorizes payment via eps and thus completes the purchase.
  8. If a delivery is made against payment via SOFORT, the CUSTOMER logs in to their online banking and authorizes the payment via a transaction authentication number (TAN) before the CUSTOMER returns to the web shop.
  9. If a delivery is made against payment via iDeal, the CUSTOMER first selects the house bank. You will then be redirected to the house bank’s online banking environment. There the CUSTOMER logs in securely with their own access data. The total amount due and other transfer information have already been filled out in the input mask, so that the CUSTOMER only needs to confirm the payment via iDEAL. After payment confirmation, the CUSTOMER will be redirected to the web shop. The CUSTOMER then immediately receives a payment confirmation.
  10. If a delivery is made against payment via Apple Pay, the CUSTOMER pays directly via their own Apple account. After submitting the order, the CUSTOMER will be redirected to Apple, where payment of the order amount can be authorized. As soon as the SELLER has been informed of the authorization, shipping will take place - depending on the delivery time specified for the item. Depending on the payment method stored in Apple Pay, the actual invoice amount will be charged immediately after authorization or after shipping, after deducting any discounts, gift vouchers, etc.
  11. If a delivery is made against payment via Google Pay, the CUSTOMER pays directly via their own Google account. After submitting the order, the CUSTOMER will be redirected to Google, where payment of the order amount can be authorized. As soon as the SELLER has been informed of the authorization, shipping will take place - depending on the delivery time specified for the item. Depending on the payment method stored in Apple Pay, the actual invoice amount will be charged immediately after authorization or after shipping, after deducting any discounts, gift vouchers, etc.

 

  1. Promotional vouchers and their redemption
  1. Promotional vouchers are vouchers that cannot be purchased, but rather vouchers that the SELLER issues as part of advertising campaigns with a specific period of validity.
  2. Promotional vouchers can only be redeemed within the specified period and only once as part of an ordering process. Individual brands may be excluded from the voucher campaign. Promotional vouchers cannot be used to purchase gift vouchers. Please note that promotional vouchers may be subject to a minimum order value.
  3. The value of the goods must be at least equal to the amount of the promotional voucher. Any difference to a higher value of goods can be offset using the payment options offered. The value of a promotional voucher will neither be paid out in cash nor interest. The promotional voucher will not be refunded if goods are returned in whole or in part.
  4. Promotional vouchers can only be redeemed before completing the ordering process. Subsequent crediting is not possible. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined with each other, unless otherwise stated in the promotion's terms and conditions.
  5. If the total value of the order falls below the respective minimum order value of the promotional voucher used due to a subsequent return of ordered goods, the SELLER reserves the right to calculate the original price of the ordered goods and to subsequently invoice the CUSTOMER.

 

  1. Gift vouchers, vouchers and their redemption
  1. WGift vouchers are vouchers for a specific purchase value that the CUSTOMER can purchase. These can only be redeemed for the purchase of items on www.fitmart.de, but not for the purchase of other gift vouchers. A cash payment is not possible.

To redeem a gift voucher, the code is entered into the field provided before completing the ordering process. The amount deposited for the gift voucher will be deducted from the value of the order. Remaining voucher amounts are retained and can be redeemed in the next ordering process by re-entering the voucher code as before. Orders that exceed the value of the voucher can be settled using the payment options offered.

  1. Vouchers are vouchers for a specific purchase value that only the SELLER issues to the CUSTOMER, e.g. B. for reasons of goodwill. They are customized, non-transferable and cannot be purchased. A cash payment is not possible.

  1. Unless otherwise agreed with the CUSTOMER, the goods delivered in a package or in another way by post will be delivered by post (package, parcel, letter, shipping company, etc.) to the person specified in the order Delivery address provided by the CUSTOMER.
  2. The delivery time is stated separately for the respective item or in the product description on the item page.
  3. For all other payment methods, the delivery time stated on the item page begins on the working day after the day the contract is concluded.
  4. Orders can be placed by all CUSTOMERS from the European Economic Area and, if applicable, the other countries specified in the online shop and/or in the shipping cost table. Orders are only delivered to Germany and to the countries specified in the online shop and/or in the shipping cost table.
  5. If the carrier returns the purchased item to the SELLER because delivery to the CUSTOMER was not possible, the CUSTOMER will bear the costs of re-shipment. This does not apply if the CUSTOMER has exercised any right of cancellation that may have existed parallel to the refused acceptance or if the CUSTOMER is not responsible for the circumstances that led to the impossibility of delivery or if the CUSTOMER was temporarily prevented from accepting the service offered , unless the SELLER had announced the service a reasonable time in advance.

 

  1. Repayments
    The SELLER automatically arranges any repayments to be made to the account used by the CUSTOMER for payment. When paying by invoice, the transfer will be directed to the account from which the transfer was made. If the CUSTOMER paid by Paypal or credit card, the refund will be made to the associated Paypal or credit card account. If the CUSTOMER used a gift or voucher for his purchase, the corresponding amount will be credited to his voucher account.

    The SELLER reserves ownership of the items sold until the purchase price has been paid in full.

  1. The CUSTOMER can create a customer account in the online shop free of charge.
  2. When creating a customer account, the CUSTOMER will be asked to provide their personal data in accordance with the SELLER's data protection declaration. By providing his data, the CUSTOMER guarantees its authenticity and accuracy. He is also obliged to keep the data up to date in the event of an order. Additional shipping costs incurred by the SELLER due to incorrect or incorrectly entered data will be charged to the CUSTOMER. After the creation of the customer account has been requested by clicking on “Create”, the CUSTOMER will receive an email.
  3. By clicking on the link contained therein, the CUSTOMER confirms his identity and receives confirmation of the creation of his customer account by email.
  4. The CUSTOMER is currently entitled to register and operate only one customer account on priceflash.shop. If the SELLER becomes aware of multiple registrations, the SELLER is entitled to exclude the CUSTOMER from using the web shop. CUSTOMERS whose customer accounts have already been blocked or terminated by us in the past are not allowed to create a new customer account. Minors are not allowed to register.
  5. CUSTOMER and SELLER can terminate the contract via the customer account at any time with immediate effect for the future without giving reasons. The SELLER reserves the right to delete the registration of CUSTOMERS who have not provided complete or incorrect data.

  2. The above choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the CUSTOMER has his habitual residence.
